Terms and Conditions
These Terms and Conditions form a legally binding agreement between MOOD INTERIORS NZ and the Customer.

1. Engagement and Services
1.1 The Customer engages MOOD INTERIORS to provide the staging and related services described in the Proposal or selected via the MOOD INTERIORS website, and agrees to pay the applicable fees.
1.2 This Agreement takes effect once the Customer accepts a service and payment is received, whether online, in writing, or electronically.
1.3 Staging services are provided on a consultative basis. Final decisions regarding selection, placement, styling, and arrangement of all staging items remain at the sole discretion of MOOD INTERIORS.
1.4 Any request to alter, restyle, substitute, or relocate staging items after installation may incur additional fees, payable in advance.
1.5 Staging items must only be used for their intended purpose and in accordance with MOOD INTERIORS’ directions. Indoor items must not be used outdoors.
1.6 Staging items must not be moved, removed, loaned, or interfered with by the Customer or any third party.
1.7 The Customer is fully responsible for all loss, theft, damage, or soiling of staging items during the staging term, excluding fair wear and tear and fault directly caused by MOOD INTERIORS.
1.8 Utilities including electricity must remain connected and operational for the full staging term.
1.9 No painting, repairs, trades, cleaning, or maintenance may occur while staging items are installed unless approved in writing by MOOD INTERIORS.

2. Delivery and Installation
2.1 Delivery dates are agreed in advance and are subject to access, site readiness, and availability.
2.2 Delivery dates may only be rescheduled with MOOD INTERIORS’ written approval. Additional fees may apply.
2.3 MOOD INTERIORS may refuse delivery if the property is unsafe, unclean, damp, unfinished, or unsuitable. Any fees already paid remain payable.
2.4 The Customer must rectify any issues identified by MOOD INTERIORS within five business days or elect to cancel and forfeit any deposit paid.
2.5 The Customer authorises MOOD INTERIORS to install artwork, mirrors, and wall hangings using appropriate fixings.
3. Access and Authority
3.1 The Customer must provide unrestricted access to the property during reasonable hours for delivery, inspection, maintenance, and removal.
3.2 The Customer warrants that they are the legal owner or have full authority to grant access.
3.3 Keys, access codes, and alarms must be provided and kept current.
4. Removal and Completion
4.1 The Customer must give at least five business days’ notice prior to the end of the staging term to arrange removal or extension.
4.2 MOOD INTERIORS may remove staging items immediately after the staging term ends if no extension is approved.
4.3 Early removal does not entitle the Customer to a refund.
4.4 MOOD INTERIORS is not responsible for minor marks, indentations, or holes caused by normal installation and removal.
5. Extensions
5.1 Extension requests must be submitted at least five business days before expiry.
5.2 Extensions are granted at MOOD INTERIORS’ discretion and must be paid in full before commencement.
5.3 Failure to pay extension fees authorises MOOD INTERIORS to recover staging items.
6. Damage and Care
6.1 Any damage or incident must be reported immediately.
6.2 Issues present on delivery must be reported within three business days.
6.3 The Customer must allow access to inspect and remedy issues within a reasonable timeframe.
6.4 The Customer accepts that small holes, marks, and impressions are normal and are not the responsibility of MOOD INTERIORS.
7. Fees and Payment
7.1 All fees are payable in advance unless agreed otherwise in writing.
7.2 Non-payment authorises cancellation, withholding of services, and recovery of costs.
7.3 All fees are exclusive of GST unless stated.
7.4 Deposits may be applied to outstanding charges.
7.5 All sales are final unless MOOD INTERIORS elects otherwise.
8. Photography and Promotion
8.1 MOOD INTERIORS may photograph the property before, during, and after staging.
8.2 Images may be used for marketing, portfolio, and promotional purposes without limitation.
8.3 The Customer may use staged images solely for marketing the property.
9. Termination
9.1 This Agreement ends on completion of the staging term unless extended.
9.2 Either party may terminate with five business days’ notice.
9.3 MOOD INTERIORS may terminate immediately if fees remain unpaid or access is denied.
9.4 Upon termination, MOOD INTERIORS may enter the property to recover staging items.

10. Risk, Liability, and Indemnity
10.1 All staging items are used at the Customer’s sole risk.
10.2 MOOD INTERIORS is not responsible for injury, loss, or damage to any person or property arising from the presence or use of staging items.
10.3 The Customer indemnifies MOOD INTERIORS against all claims, losses, costs, and expenses arising from:

Damage or loss of staging items

Injury to occupants, agents, or visitors

Breach of this Agreement

Third-party actions
10.4 To the maximum extent permitted by law, MOOD INTERIORS excludes all liability for indirect or consequential loss, loss of profit, delay, or opportunity.
10.5 Where liability cannot be excluded under New Zealand consumer law, liability is limited at MOOD INTERIORS’ option to resupply or refund of the service fee paid.
10.6 Total liability is capped at the amount actually paid for the staging service.
11. Insurance
11.1 The Customer is responsible for insuring the property and contents during the staging term.
11.2 MOOD INTERIORS does not provide insurance cover for the Customer.
12. Force Majeure
12.1 MOOD INTERIORS is not liable for delays or failure caused by events beyond reasonable control including weather, supply chain disruption, illness, accident, or government action.
13. General
13.1 Title to all staging items remains with MOOD INTERIORS.
13.2 If the Proposal conflicts with these Terms, the Proposal prevails.
13.3 Amendments must be in writing.
13.4 MOOD INTERIORS may subcontract services.
13.5 This Agreement is governed by New Zealand law.
13.6 Electronic acceptance is binding.
13.7 Invalid provisions do not affect enforceability of the remainder.
14. Definitions
Key terms including Customer, Proposal, Fees, Staging Items, Staging Services, Staging Term, and Premises have the meanings set out in your original definitions, with all references applying to New Zealand law and currency.
